Website Terms of Use

  • Privacy Policy
  • Website Terms of Use
  • Client Services Terms
  • Cookie Notice

Effective: 5 October 2026

These Website Terms of Use (Terms) apply to the website operated by AMTEC ADVISORY PTY LTD (ABN 92 697 826 627) (Amtec, we, us or our) at https://www.amtecai.com, including associated webpages, artificial-intelligence assistants, chat interfaces, forms, booking functionality, demonstrations, interactive tools, downloads, APIs made available for public Website use and other functionality controlled by Amtec (Website).

By accessing or using the Website after being given reasonable notice of these Terms, you agree to these Terms to the extent applicable to your use.

If you submit an enquiry, send a message through an artificial-intelligence assistant, use an interactive feature, book a meeting or otherwise actively submit information through the Website after being presented with notice of these Terms, you expressly agree to them.

If you do not agree, you must not use the relevant Website functionality.

These Terms govern use of the Website only. Paid consulting, development, implementation, hosting, advisory or other Client Services are governed by the applicable Scope of Work, Amtec Client Services Terms and any other agreement expressly entered into between Amtec and the Client.

1. About Amtec and the Website

Amtec is an Australian technology and advisory business that designs and implements artificial-intelligence, automation, integration, data, software, workflow and related systems.

The Website provides information concerning Amtec, our experience, approach, services, technology and business activities and may allow prospective clients and other visitors to interact with Amtec or automated functionality.

Unless expressly stated otherwise, Website content is provided for general information, evaluation and business-enquiry purposes.

Website content is not, by itself:

  • a binding offer;
  • a quotation;
  • a contractual specification;
  • a Scope of Work;
  • a warranty;
  • a promise that Amtec will accept an engagement;
  • a representation that any particular solution is suitable for your circumstances; or
  • a commitment to provide any particular functionality, price, timetable or commercial outcome.

2. No Client relationship created through Website use

Accessing or using the Website does not itself create a client, adviser, fiduciary, employment, partnership, joint-venture, agency or other professional relationship between you and Amtec.

Submitting an enquiry, communicating with an Amtec artificial-intelligence assistant, booking a meeting, requesting an audit or speaking with an Amtec representative does not oblige Amtec to accept an engagement.

A Client engagement arises only through a proposal, Scope of Work, order, agreement or other arrangement expressly accepted in accordance with Amtec's contracting process.

If Website content is inconsistent with a subsequently accepted Scope of Work or Client agreement, the accepted Client agreement governs the Client Services to the extent of that inconsistency.

3. Authority

If you use the Website on behalf of a company, partnership, organisation or other entity, you warrant that you have authority to submit the information you provide and to communicate with Amtec on that entity's behalf.

Your use of the Website does not, merely because you act for an organisation, create a Client Services engagement on behalf of that organisation.

You must not falsely represent that you have authority to act for another person or organisation.

4. No professional advice

Website content is general information only.

Unless expressly agreed under a separate professional engagement, Amtec does not provide through the Website:

  • legal advice;
  • financial or investment advice;
  • financial-product advice;
  • credit advice;
  • accounting or tax advice;
  • medical or clinical advice;
  • employment or workplace advice;
  • regulatory advice;
  • privacy or data-protection legal advice;
  • cybersecurity assurance;
  • compliance certification; or
  • any other regulated or licensed professional advice.

Information about artificial intelligence, automation, technology, data, security, marketing, financial-services systems, healthcare systems or other business processes must not be treated as advice tailored to your circumstances.

You remain responsible for obtaining appropriate professional advice where required.

5. Artificial-intelligence assistants and automated Website functionality

The Website may include artificial-intelligence assistants, chatbots, automated recommendations, search functionality, demonstrations, estimators or other automated systems.

Amtec will identify public-facing artificial-intelligence assistants as automated systems where reasonably practicable.

Artificial-intelligence and automated outputs may be probabilistic and may contain errors, omissions, outdated information, incorrect interpretations, incomplete information, inconsistencies or unexpected results.

You must independently verify information where it is material to a legal, financial, commercial, security, regulatory, operational, employment, health or other significant decision.

5.1 No authority to bind Amtec

No artificial-intelligence assistant, chatbot or other automated Website functionality has authority to:

  • enter into a contract on behalf of Amtec;
  • accept a Client engagement;
  • approve or vary a Scope of Work;
  • approve a Change Request;
  • waive a contractual right;
  • make a binding admission;
  • provide a final or binding quotation;
  • commit Amtec personnel or resources;
  • promise a delivery date;
  • agree that particular functionality is within an existing Scope;
  • make a legally binding warranty or undertaking; or
  • override a written communication from an authorised Amtec representative.

Any pricing, capability statement, timeline, recommendation, proposed architecture or other information generated through automated functionality is subject to appropriate human review and the applicable Client contracting process.

5.2 Conflicts with authoritative information

If an automated response conflicts with an accepted Scope of Work, Client Services Terms, an authorised written quotation, a signed contract or a written direction from an authorised Amtec representative, the applicable authorised written document or communication prevails.

Nothing in this clause excludes responsibility for conduct or representations that cannot lawfully be excluded.

6. Case studies, examples and prior experience

The Website may contain case studies, project descriptions, examples, demonstrations, performance information and references to work undertaken by Amtec or experience obtained by Amtec personnel.

Amtec may distinguish between:

  • Amtec clients or projects, being work performed by Amtec; and
  • team experience, being experience obtained by Amtec personnel through previous employers, engagements or organisations.

A reference to team experience does not represent that the relevant organisation is or was an Amtec client.

Third-party names and trade marks remain the property of their respective owners.

Unless expressly stated, their appearance on the Website does not imply sponsorship, endorsement, partnership or approval of Amtec.

7. Results and performance information

Case studies, examples, testimonials, demonstrations and previous project results reflect particular circumstances.

They do not guarantee that another Client or user will achieve the same or similar revenue, cost savings, conversion, automation rate, productivity improvement, lead volume, response rate, search ranking, accuracy, adoption, processing time, system performance or other outcome.

Results may depend on circumstances including data quality, systems, integrations, third-party providers, requirements, personnel, implementation, operating conditions, Client decisions and human adoption.

Where the Website contains quantitative performance information, that information must be understood in the context stated with the relevant example.

8. Estimates, forecasts and future matters

Any estimate, forecast, prediction, potential saving, proposed implementation period, expected capability or other statement concerning future performance is based on assumptions and information reasonably available when the statement is made.

Actual outcomes may differ.

Unless expressly stated in a binding agreement, such information is indicative and not a contractual commitment.

Nothing in these Terms limits Amtec's obligation under applicable law to have reasonable grounds for representations concerning future matters.

9. Pricing information

Unless expressly issued as a binding quotation by an authorised Amtec representative, any Website reference to pricing, costs, savings, budgets, commercial models, implementation costs, subscription costs, usage costs or expected project size is indicative only.

Actual pricing depends on matters such as Scope, integrations, requirements, project risk, dependencies, data, implementation complexity, third-party products and required personnel.

Final Fees are governed by the applicable quotation, proposal or Scope of Work.

10. Licence to use the Website

Subject to these Terms and applicable law, Amtec grants you a limited, revocable, non-exclusive, non-transferable licence to access and use the Website and publicly available Website content for lawful personal use, internal business evaluation, research, evaluation of Amtec's services and communication with Amtec.

This licence does not transfer ownership of Website content or intellectual property.

All rights not expressly granted are reserved.

Amtec may revoke this licence in relation to particular use where that use materially breaches these Terms or where restriction is reasonably necessary under clause 24.

11. Prohibited conduct

Except to the extent expressly authorised by Amtec in writing or permitted by law, you must not engage in the conduct described in this clause.

11.1 Unlawful or deceptive use

You must not use the Website unlawfully, fraudulently, deceptively, to facilitate unlawful conduct, to infringe another person's rights or to misrepresent your identity, authority or affiliation.

11.2 Unauthorised access

You must not attempt to obtain unauthorised access to non-public Website functionality, servers, databases, accounts, credentials, source code, infrastructure, administration tools, internal APIs, internal documentation, confidential information or systems connected to the Website.

11.3 Security testing

Without Amtec's prior written authorisation, you must not conduct penetration testing, vulnerability scanning, credential testing, port scanning, automated enumeration, exploit testing, authentication bypass testing, denial-of-service testing, data exfiltration testing or other security testing against Amtec systems.

Nothing in this provision prohibits activity that cannot lawfully be restricted.

11.4 Circumvention

You must not circumvent or attempt to circumvent authentication, rate limits, bot protections, access controls, security measures, usage restrictions, technological protection measures or other technical controls.

11.5 Malicious activity

You must not introduce, upload, transmit or cause the execution of malware, viruses, ransomware, malicious scripts, destructive code, harmful payloads, unauthorised commands or material intended to compromise, impair or interfere with systems or data.

11.6 Interference

You must not intentionally disrupt, overload, degrade, disable, damage, impair or materially interfere with the Website, Amtec's infrastructure, other users or connected systems.

11.7 Reverse engineering

Except to the extent expressly permitted by law, you must not reverse engineer, decompile, disassemble or attempt to derive source code, private APIs, internal architecture, hidden functionality, private configuration, system prompts, model instructions, security controls or other non-public implementation details of the Website or any interactive feature.

11.8 AI prompt and model attacks

You must not intentionally use prompt-injection, jailbreak, model-extraction or similar techniques to attempt to reveal hidden prompts, reveal system instructions, obtain credentials, obtain confidential information, access private tools or APIs, override security restrictions, make the system perform unauthorised actions, obtain non-public information or interfere with intended system behaviour.

11.9 Impersonation

You must not impersonate Amtec, an Amtec employee or contractor, a Client, a supplier, another user or any other person.

You must not falsely state or imply sponsorship, endorsement, partnership, employment or association with Amtec.

12. Automated access, scraping and data extraction

Except where permitted by law or expressly authorised by Amtec in writing, you must not use automated systems to systematically scrape, crawl, spider, harvest, extract, download, copy, index, reproduce or aggregate Website content for commercial exploitation, database creation or reproduction of a substantial part of the Website.

Automated access must comply with any applicable robots.txt instructions, crawler directives, rate limits, machine-readable permissions and technical access controls published or implemented by Amtec.

Legitimate public search-engine indexing for the purpose of providing ordinary search results is permitted where consistent with Amtec's technical instructions.

13. Artificial-intelligence training and datasets

No licence is granted under these Terms to reproduce or systematically use Website content or a substantial part of Website content for training an artificial-intelligence or machine-learning model, fine-tuning a model, model distillation, model-weight extraction, creating a training dataset, creating a commercial retrieval corpus, reproducing Amtec's proprietary workflows or methodologies, developing a substantially derivative commercial system or commercial model evaluation using substantial copied Website content, without Amtec's prior written permission, except to the extent such activity is expressly permitted by law.

This clause does not prohibit ordinary indexing, citation or linking that does not infringe Amtec's rights or breach applicable machine-readable access instructions.

14. Address harvesting and spam

You must not harvest, extract or compile email addresses, telephone numbers or other contact information from the Website for unlawful unsolicited commercial communications, spam, unlawful telemarketing, resale of contact lists or other unlawful direct-marketing activity.

Use of contact information obtained from the Website must comply with applicable law, including where relevant the Spam Act 2003 (Cth).

15. Intellectual property

Unless otherwise stated, Amtec or its licensors own all intellectual-property rights in the Website and its content.

This may include rights in written content, articles, designs, illustrations, graphics, images, videos, layouts, interfaces, animations, source code, compiled software, prompts, workflows, methodologies, templates, diagrams, documentation, data structures, architecture, case studies, demonstrations, trade marks, branding and downloadable materials.

Nothing in these Terms transfers ownership of intellectual property to you.

No licence should be inferred merely because content is technically capable of being accessed, inspected, downloaded, cached, copied or reproduced.

Nothing in these Terms limits a right that applicable law gives you independently of these Terms.

16. Amtec names, trade marks and branding

You must not use Amtec's names, logos, branding, trade marks or other brand identifiers in a manner that falsely implies affiliation, sponsorship or endorsement, misrepresents Amtec, passes off another business as Amtec, infringes Amtec's rights or is otherwise unlawful.

Any permitted factual reference to Amtec must be accurate and must not create a misleading impression of association or endorsement.

17. Third-party intellectual property

Third-party names, logos, trade marks, software and other materials displayed or referred to on the Website remain the property of their respective owners.

Use of a third-party name or mark may identify a Client, a supplier, an integration, technology used, previous team experience or another relevant relationship expressly described on the Website.

Unless expressly stated, the reference does not imply that the third party sponsors or endorses Amtec.

18. Information you submit

You warrant that, to the best of your knowledge, information you submit is accurate and not deliberately misleading, you have authority to provide it, your submission is lawful and Amtec's use of it for the purpose for which you submitted it will not infringe another person's rights.

You must not knowingly submit unlawful, defamatory, malicious, fraudulent or infringing material.

19. Sensitive information and credentials

Do not submit through a general Website form or public-facing AI assistant passwords, private keys, API secrets, authentication tokens, production credentials, unredacted identity documents, sensitive personal information, confidential source code, regulated Client datasets or other security-critical information, unless Amtec expressly requests that information and nominates an appropriate method for providing it.

If information is submitted despite this clause, Amtec's obligations under applicable privacy law and any separately binding confidentiality obligations are not excluded.

20. Licence for submitted materials

You grant Amtec a non-exclusive licence to receive, reproduce, store, transmit, process and use material you voluntarily submit through the Website only to the extent reasonably necessary to respond to your enquiry, provide requested Website functionality, assess a potential engagement, arrange a meeting, communicate with you, maintain appropriate business records, investigate security or misuse, comply with law and protect Amtec's legal rights.

This clause does not transfer ownership of your pre-existing intellectual property to Amtec.

Personal information is handled in accordance with the Privacy Policy and applicable privacy law.

21. Unsolicited confidential information

Unless Amtec has already entered into a confidentiality agreement applicable to the information, an existing Client agreement requires confidentiality or an authorised Amtec representative has expressly agreed in writing to receive particular information in confidence, you should not submit proprietary, confidential or commercially sensitive material through general Website forms, chatbots or unsolicited communications.

Labelling unsolicited material "confidential" does not, by itself, create a contractual confidentiality obligation.

Nothing in this clause limits obligations imposed by privacy law, existing duties of confidence, obligations under an existing contract or confidentiality obligations expressly accepted by Amtec.

22. Feedback

If you voluntarily provide general feedback, suggestions or ideas about Amtec's Website or services, and that feedback is not confidential information governed by a separate agreement, Amtec may use the feedback for legitimate development and improvement purposes without an obligation to compensate you.

This clause does not transfer ownership of pre-existing intellectual property contained in the feedback.

23. Forms, bookings and enquiries

The Website may allow you to submit an enquiry, request information, book a meeting, request an audit, interact with an assistant or otherwise contact Amtec.

You must not use those facilities for spam, to create fictitious bookings, to harass Amtec personnel, to submit malicious content, to automate excessive requests or for purposes unrelated to legitimate communication with Amtec.

A confirmed meeting booking confirms the meeting reservation only. It does not confirm acceptance of a Client engagement or particular project Scope.

24. Restriction and suspension of Website access

Amtec may take proportionate and reasonable steps to restrict or suspend particular access to the Website where Amtec reasonably considers this necessary to protect Website or system security, protect confidential information or personal information, prevent material disruption, respond to suspected malicious activity, prevent excessive automated use, address a material breach of these Terms, protect another person's rights, comply with law, regulation or court order, investigate suspected fraud or abuse or undertake necessary maintenance.

Where appropriate and reasonably practicable, Amtec may remove a restriction when the reason for the restriction has been resolved.

This clause does not give Amtec an unrestricted right to interfere with rights that cannot lawfully be limited.

25. Reporting security vulnerabilities

If you discover a suspected security vulnerability affecting the Website, you should promptly notify Amtec at admin@amtecadvisory.com.

If you discover a vulnerability accidentally, you should cease further testing that may access non-public information, affect other users, alter information or impair system operation unless Amtec gives written permission to continue.

Reporting a vulnerability does not itself authorise continued exploitation, unauthorised access, persistence, credential access, data extraction, data modification, disclosure of personal or confidential information, denial-of-service activity or further penetration testing.

Amtec may separately authorise agreed security testing in writing.

26. Third-party websites and services

The Website may contain links to or integrate with third-party websites, booking providers, cloud services, AI model providers, analytics services, social networks, software, APIs or other products.

Amtec does not control third-party services and cannot guarantee their availability, security, accuracy, privacy practices, functionality or continued operation.

Your use of a third-party service may be governed by that provider's own terms and policies.

A link or technical integration does not, by itself, constitute endorsement.

27. Availability

Amtec takes reasonable care in operating the Website but does not guarantee continuous or uninterrupted availability.

Availability may be affected by maintenance, upgrades, hosting incidents, network failures, third-party outages, security events, technical errors, force-majeure events or circumstances outside Amtec's reasonable control.

The Website is not designed to operate as an emergency, safety-critical, business-continuity or mission-critical system.

You should not rely on continuous Website availability for those purposes.

28. Website security

Amtec takes reasonable steps appropriate to the Website to protect its systems.

No internet-connected service is completely secure.

You remain responsible for maintaining reasonable security over your devices, accounts, credentials, networks, browsers, software and information you choose to submit.

Nothing in these Terms reduces Amtec's obligations under applicable privacy, consumer, cybersecurity or other law.

29. Accuracy and currency

Amtec takes reasonable care in preparing Website content but information may become outdated because technology, services, pricing, laws, providers and business practices change.

Unless expressly stated otherwise, Amtec does not warrant that all general Website information is at all times complete, current or suitable for every purpose.

Where you identify a material error, you may notify Amtec so it can be reviewed.

Nothing in this clause excludes responsibility for misleading or deceptive conduct or another obligation that cannot lawfully be excluded.

30. Privacy

Amtec's Privacy Policy explains how Amtec collects, holds, uses and discloses personal information.

Public-facing artificial-intelligence and other interactive functionality may involve processing by technology providers used to operate the functionality, as further described in the Privacy Policy and any applicable collection notice.

You should review the Privacy Policy before submitting personal information.

Nothing in these Terms limits rights or obligations under the Privacy Act 1988 (Cth) or other applicable privacy law.

31. Cookies and analytics

The Cookie Notice explains cookies and related technologies used by the Website.

Analytics and technical telemetry may be used for Website operation, security, reliability, usage analysis, troubleshooting and service improvement, subject to the Privacy Policy and applicable law.

32. Australian Consumer Law

Nothing in these Terms excludes, restricts or modifies any consumer guarantee, statutory right, statutory remedy, liability or other right that cannot lawfully be excluded, restricted or modified under the Competition and Consumer Act 2010 (Cth), the Australian Consumer Law or other applicable law.

Where these Terms would otherwise be inconsistent with such a right, these Terms operate subject to that right.

33. Liability

To the maximum extent permitted by law, Amtec is not liable for loss to the extent arising from reliance on general Website information contrary to these Terms, reliance on an automated output without appropriate verification, use of Website information for a purpose for which it was not intended, use of the Website in breach of these Terms, third-party websites, platforms, models or services, unauthorised or malicious conduct of a third party that Amtec could not reasonably prevent, decisions made without professional advice where such advice would reasonably be appropriate or temporary Website unavailability outside Amtec's reasonable control.

To the maximum extent permitted by law, and in relation to free public Website use only, Amtec excludes liability for indirect or consequential loss and for loss of profit, revenue, opportunity, goodwill, reputation, anticipated savings or data, except to the extent the loss is a direct and reasonably foreseeable consequence for which liability cannot lawfully be excluded.

This clause does not apply so as to exclude or limit liability that cannot lawfully be excluded or limited, fraud or wilful misconduct by Amtec, or rights arising under a separate Client Services agreement to the extent that agreement governs the relevant matter.

Liability concerning paid Client Services is governed by the applicable Client agreement and Client Services Terms.

34. Your responsibility and indemnity

To the maximum extent permitted by law, you indemnify Amtec and its personnel against third-party claims and reasonable external losses, liabilities and costs to the extent directly arising from your unlawful or fraudulent use of the Website, material submitted by you without necessary rights or authority, infringement of a third party's intellectual-property or other rights by your conduct, malicious or unauthorised access or security activity conducted by or on your behalf, unlawful automated scraping or harvesting conducted by or on your behalf, unlawful spam or contact harvesting conducted by or on your behalf, or your material breach of these Terms.

This indemnity applies only to the extent the relevant matter was caused by your conduct, is reduced to the extent Amtec caused or contributed to the relevant loss, does not require you to indemnify Amtec for Amtec's own fraud, wilful misconduct or breach, and does not apply where liability cannot lawfully be allocated in this manner.

Amtec must take reasonable steps to mitigate an indemnified loss.

35. International access

The Website is operated from Australia.

If you access it from another jurisdiction, you are responsible for complying with laws applicable to your own conduct.

Nothing in these Terms excludes any mandatory right applicable to you that cannot lawfully be excluded by an Australian governing-law clause.

36. No waiver

If Amtec does not enforce a right on a particular occasion, that does not by itself waive the right on another occasion.

Providing assistance, answering an enquiry, investigating an issue or permitting particular activity on one occasion does not create an ongoing permission unless expressly agreed.

37. Severability and reading down

If a provision of these Terms is invalid, illegal or unenforceable, the provision is to be read down to the minimum extent necessary to make it valid and enforceable.

If it cannot be read down, it is severed.

The remaining provisions continue to operate to the extent legally possible.

38. Changes to the Website

Amtec may reasonably change, improve, replace, suspend or discontinue Website content or functionality to reflect product development, business requirements, security, technology, third-party services, legal requirements or operational needs.

This clause does not permit Amtec to retrospectively alter a separate Client agreement.

39. Changes to these Terms

Amtec may update these Website Terms prospectively.

The current version will display its effective date.

An updated version applies to Website use occurring after the updated version becomes effective and after reasonable notice has been made available.

An amendment does not retrospectively alter rights that have already accrued, create liability for conduct that occurred before the amendment or amend a separate Client Services agreement.

Superseded versions may remain published for reference.

40. Relationship with other Amtec terms

These Website Terms govern public Website use.

Where applicable:

  • the Privacy Policy governs Amtec's handling of personal information;
  • the Cookie Notice governs Website cookies and related technologies;
  • the applicable Scope of Work and Client Services Terms govern paid Client Services; and
  • another expressly accepted agreement may govern specific services or functionality.

If a specific Client agreement expressly conflicts with these Website Terms regarding Client Services, the specific Client agreement prevails for those Services.

41. Entire agreement regarding Website use

Subject to any right that cannot lawfully be excluded and any separate agreement between the parties, these Terms record the agreement between Amtec and the Website user concerning public use of the Website.

Nothing in this clause excludes liability for fraud or misleading or deceptive conduct that cannot lawfully be excluded.

42. Governing law and jurisdiction

These Terms are governed by the laws of Victoria, Australia.

Subject to any mandatory right that cannot lawfully be excluded, the courts of Victoria and courts entitled to hear appeals from them have non-exclusive jurisdiction.
